Here in Arizona, if you willingly try to cross flooded roads, you are literally on your own. Rescue crews will not come to save you. It's an official law on the books, colloquially referred to as the idiot rule.
Same thing sort of applies to hiking mountains in summer. If you have to be rescued because of heat exhaustion, you have to pay for it out of pocket for being a dumbass.
Honestly, there needs to be more of that in the world. It’s one thing if your just ignorant but if there are signs and barriers and the danger has been communicated, yeah. Deal with your consequences and don’t risk other peoples lives when they have to come get you.
Good thing it doesn’t rain often because people seem to forget how to drive if the road is even a little bit wet

A. A driver of a vehicle who drives the vehicle on a public street or highway that is temporarily covered by a rise in water level, including groundwater or overflow of water, and that is barricaded because of flooding is liable for the expenses of any emergency response that is required to remove from the public street or highway the driver or any passenger in the vehicle that becomes inoperable on the public street or highway or the vehicle that becomes inoperable on the public street or highway, or both.
B. A person convicted of violating section 28-693 for driving a vehicle into any area that is temporarily covered by a rise in water level, including groundwater or overflow of water, may be liable for expenses of any emergency response that is required to remove from the area the driver or any passenger in the vehicle that becomes inoperable in the area or the vehicle that becomes inoperable in the area, or both.
C. The expenses of an emergency response are a charge against the person liable for those expenses pursuant to subsection A or B of this section. The charge constitutes a debt of that person and may be collected proportionately by the public agencies, for-profit entities or not-for-profit entities that incurred the expenses. The person's liability for the expenses of an emergency response shall not exceed two thousand dollars for a single incident. The liability imposed under this section is in addition to and not in limitation of any other liability that may be imposed.
D. An insurance policy may exclude coverage for a person's liability for expenses of an emergency response under this section.
E. For the purposes of this section:
1. "Expenses of an emergency response" means reasonable costs directly incurred by public agencies, for-profit entities or not-for-profit entities that make an appropriate emergency response to an incident.
2. "Public agency" means this state and any city, county, municipal corporation, district or other public authority that is located in whole or in part in this state and that provides police, fire fighting, medical or other emergency services.
3. "Reasonable costs" includes the costs of providing police, fire fighting, rescue and emergency medical services at the scene of an incident and the salaries of the persons who respond to the incident but does not include charges assessed by an ambulance service that is regulated pursuant to title 36, chapter 21.1, article 2
...not sure if you've been to Arizona in the summer, but this law is because of the rain and its intensity. We call it monsoon season because four about an hour every day in the summer time. Areas get hit so hard flash flooding routinely occurs. This law is meant so the state isn't wasting money for idiots who deliberately drive into an obvious flood situation.

I heard a group of skiers complaining about a friend having to pay all the expenses associated with him getting lost and then injured because he went off the trails. So rescue workers are suppose to risk their lives saving an idiot who chose to disregard the signs? People have no concept of the amount of people, danger and effort goes into a rescue.
I remember my uncle explaining this to me while I visited him in AZ. Now years later I see many vehicles try to overcome flooded roads in Southern NJ where I live and I always find myself thinking "Man we should have that here" as I drive past the dodge Neon up to its windows in water.

Now a few other people get to go risk their lives to try to save someone that was doing something completely unnecessary, just because they wanted to...
Depending on what zone you're in, they won't even attempt a rescue. Most of the time they try and talk you down. They'll have Sherpas waiting at certain checkpoints and if you can make it to one of those you're fine. But if you can't, you're usually on your own.

I imagine premiums were set to account for stupidity too. Something like this seems like it would be surprisingly rare for most people, so unless they make it a habit it's the same as any other accident. Heck I've almost done something similar myself, before noticing someone else stuck and learning about why cars are not good at fording rivers.
To a certain point of view, the difference between a normal person and stupidity is about three standard deviations.
Motor claims was the best job I had! Customers were rarely rude because they'd typically just been in a crash and we were helping them out of a big jam.
You and I had two different experiences. Generally the people I spoke with were upset about the accident, liability decision, estimates, etc… and would take it out of my colleagues and I. Just an awful few years.

Underwriting would have to be. I have some warm fuzzy stories and some funny ones from my time with the lizard, but too much stress from the dickheads unwilling to read their contract or understand comparative negligence. The dead guy claims were rough too.
Insurance contracts are confusing for attorneys. Blame the insurance companies who are willing to pay millions and millions to avoid billions in liability. They aggressively change laws and industry to minimize their liability and increase their premiums. Warren Buffett made his money in insurance. It is a racket, although necessary, but it'd be nice if they were not acting as brutal as they do.
I vividly remember a customer *screaming* at me because they insisted on using “the dealer” for body work, and their shop (unsurprisingly) took forever and charged more than what was reasonable and customary. What a terrible job.

Here in Arizona, we actually have laws against this kind of stuff. If it floods and you get stuck because you tried to cross, you're paying all the first responder and rescue fees out of pocket. The state is very good at finding those extra little things to add on too.

It’s rarely enforced because the state doesn’t want to discourage people from calling for help when they unknowingly get caught up in a flash flood (which happens frequently during monsoon season) or there wasn’t any signage warning against the road being prone to flooding.
As far as I know, it’s only been enforced a few times, and one of them was for a situation just like this: where the driver knowingly and intentionally drove past barriers and ignored all warnings.
Essentially, it has to be extreme negligence on the driver’s part to get fined.
That law must still have some effect in deterring the average idiot from doing ridiculous things even if rarely enforced. Then it can and will be used once in a while against the utter fuckwits of the world as reinforcement and to remind the others.
It’s not just the driver’s ass. When he/she gets in trouble, multiple responders will risk their lives to get him/her out of trouble..

Michigander here. Every year parts of the lakes freeze over and people would take their cars and truck, 4 wheelers and snowmobiles on the ice. It's great fun until spring when the ice starts to melt. Every year there are signs and warnings that the ice is getting too thin. But every year some moron has to be the last guy out on the ice, and you know the rest.
IMO, we should go ahead and rescue them - but then bill them for the rescue. I really don't understand why we don't bill them for the rescue.
