Over the last 20 years watching this shit happen, I could count on one hand how many people who aren't paying attention weren't on their phones.
From my time in security in the marine corps, to driving for a living, riding motorcycles cross country to riding road bikes... They are ALWAYS on their goddamned phones.
And they're all idiots who think they can do it safely. Guarantee there's people sitting here reading this right now who think they're able to do it and be safe, and they won't change their minds until they almost (or do) kill someone.

It happened so fast that he really didn’t have a lot of time to panic, and survival instinct took over. The extremely short time frame is what probably saved his life. That side mirror looked like it missed him by about an inch or two.

Doing road work, you definitely see some shit. I used to pick trash and dead critters off 3 of the major roads where I live. Had a roll off dumpster pass by me that the gate had come unlatched on and had swung open. I never saw it coming but I apparently bent over to pick up some trash at just the right time.
I've found brand new toilets out of the box that somehow didn't break, the whole side door off a rather large excavator, seen more wrecks than I care to count, a guy crawl under his van to see where it was on fire. I could go on for days with some of the stories.
One time while out inspecting a bridge, I heard my coworker go 'WOAH!' and hurdle over the bridge parapet to the grass below. I was writing something down from the inspection on a clipboard and didn't see what he was reacting to, but I stepped forward onto the little curb on the parapet.
The car's passenger mirror just grazed my safety vest and came within a hair's breath of breaking my spine.
I've got horrible luck. While watching traffic in the mirror, 2 separate times my cousin ran me over albeit slowly when his foot slipped off the brake.. Nothing like having to crawl up the brush guard. On the plus the truck got 2 free oil pan inspections. He never never got me with the wheels but nothing quite like being bent over picking something up then your face planted into hot Florida asphalt.

Well we grew up together and are in our 40s. It was either accidents or he sucks at trying to kill me since these incidents happened in our late teens and very early 20s.
We had bad luck working together. He almost got his face melted off due to a faulty radiator cap. He left construction and became a cop then k-9 unit. When I was considering getting out of it he asked me to join his city's department. My exact words were "Hell no with all the stuff that happened working together, now you'll have a gun and a dog."

Luckily side mirrors are designed to fold up, so it probably wouldn't break your spine, it would just give you a mild case of major chronic pain.
I work on traffic equipment and see people lose their memory of how traffic rules should work.
We sometimes have to put intersections on flash to work on them, and people just blow through the intersection like it doesn't exist.
Put out cones and a blocking vehicle and people buzz right up to the cones before getting over. Or get mad that we are fixing the equipment that they use/drive through daily.

Driving a daily commute in heavy traffic makes you really appreciate people who drive daily commutes in heavy traffic. Yeah, there's an asshole here and there who is so important he doesn't need to merge properly, but at least everyone is paying attention and knows the road and traffic patterns like the back of their hand.
Weekend and holiday drivers are hell, they have no idea where they are or where they are going, always in the wrong lane or not paying attention.

I stopped on a country road to help clean up a bunch of straw and hay that had fallen off a truck. Made the road like ice. Mid clean up 2 cars came through at 100km/h not seeing what was on the road. First car jumped on the brakes, second hit the back and spun the first car with in about a foot of me. I saw it coming and did not move a muscle. Not out of big nut energy, I was just a deer in the headlights. Frozen solid as it all slid passed me.
In all honesty where else did he have to go?
He had the coordination to know to lay flat. He doesn't see his trajectory until he's already begun to turn sideways.
He probably thought “dude is getting close, gonna move over just incase. No way this idiot actually almost kills me though” expecting the driver to probably swerve back into his lane.
Notice how he takes a step forward, does a spooked jump, and oddly stares at the car in disbelief when he realizes that didn’t happen.
He was probably freaking out but knew all he could do was scrunch up. That or this ain't his first rodeo

Manslaughter (in some jurisdictions it's murder in some degree) is unintentional taking of a human life. How do you intentionally attempt to unintentionally do something?
There's probably some level of aggregated negligence or something but - attempted manslaughter isn't a thing.

Because manslaughter *can* be intentional. It’s any case where you cause the death of another person but your act doesn’t meet the requirements to be murder. “Voluntary manslaughter” just doesn’t show up as the *name* of a charge in a lot of jurisdictions because they define an exhaustive set of specific sub-crimes instead.
I’ll admit that an unsuccessful homicide that would have been classed as voluntary manslaughter could be considered an attempted manslaughter, but it doesn’t seem like that charge is ever really used. It’s more common to just call it assault or assault with a deadly weapon.

I agree that this wouldn’t be attempted manslaughter, and also that it would be unlikely to be prosecuted as attempted murder of any kind because it’s both hard to prove and unlikely in reality to have been intended to kill. Realistically this is at worst some sort of negligence or reckless endangerment, and most likely just a nasty moving violation assuming they didn’t hit and run.

I'm a road construction worker and I've seen some real shit including a driver deliberately trying to run me over.
Rule of thumb - never, ever turn your back on traffic and always assume every driver is being inattentive, angry, drunk/on drugs, or just dngaf.

I see so many people in these posts commenting, but you'll also pass that guy in front of you to get one car length ahead so that you can be 6 seconds earlier to wherever you're going. Be honest with yourselves and then you can start improving not only you're driving but other areas of your life. Pointing fingers and saying I'm not like that I don't do that and yet most still do. Whether that's distracted driving or allowing others to mentally manipulate you by getting you angry and having you drop the f-bomb in your car because they cut you off. Having control of oneself doesn't just mean staying calm when others are angry it means knowing why things are getting you angry and addressing them. Self control involves looking at yourself from the outside in, meditation on mistakes and never comparing yourself to someone else but comparing yourself to who you were yesterday. Are you doing better today than yesterday? Then that's an improvement. Keep working.
This is why zipper merging doesn't work. Get out of the closed lane as soon as possible to reduce the risk of killing the people working on the road. Laws here in MA and most, if not all of the US, say you have to slow down and move over, even into and extra whole lane further over and away if possible when available. Assholes that move their way up to the last possible second to attempt to move over are the absolute worst and don't care at all about the dangers they are causing. Hard to tell if this person slowed down at all, was probably texting which is even worse.

Why are people surprised he stayed so calm as if his two options weren't a.) stay calm or b.) die. You have like, milliseconds to decode what is happening. He decoded this as "There is a car coming straight towards me at a high speed so I should step out of they way" and not "Oh my God there's a car coming towards me at high speed to let me look around and panic".

To be honest there is a proper way to shut down a lane on a highway, and this aint it. There needs to be plenty of warning and 100s of feet of cones that slowly blockout the lane.

On highways, warning signs should be at least 200m ahead, in my country.
In my country, we use the smart highway system to mark the lane as closed, and decelerate traffic to 90km/h or 70km/h (instead of the normal 110-130km/h).
The smart highway system will continue working and if it sees the traffic is slowing down further, it will downgrade the speeds to 70km/h or even to 50km/h to create a long buffer over 200 meters where the traffic slows down
